Acceptance of Terms

By accessing or using CirclePe's services (referred to as "Services"), you acknowledge and agree to these Terms and Conditions ("Terms"). Your continued use of the Services constitutes acceptance of these Terms.

The "CirclePe" brand, including the domain name (https://www.circlepe.club), (https://www.circlepe.com), is exclusively owned by CirclePe Private Limited. All associated legal rights, titles, and interests, including intellectual property rights, belong to CirclePe.

Ownership and Use of Intellectual Property

• Users are prohibited from using CirclePe's trademarks, logos, service marks, domain names, or any other distinctive features without prior written permission.
• Users must not copy, distribute, modify, reverse engineer, or exploit any part of the Services, unless explicitly authorized.
• Proprietary rights notices (e.g., trademark and copyright notices) must not be removed or altered.

Confidentiality

The Services may contain confidential information. Users agree to maintain confidentiality and not disclose such information without prior written consent from CirclePe.

Users must not create derivative works, attempt to discover source codes, or transfer any rights related to the Services without permission.

User Obligations

• Users agree not to use the Services for unlawful purposes or in violation of these Terms or applicable laws.
• CirclePe reserves the right to suspend or terminate access to the Services for any violation without prior notice.
• Users agree to follow the obligations in the Leave & License agreement.

Eligibility

• Users must be at least 21 years of age, mentally competent, and residents of India as per the Foreign Exchange Management Act, 1999.
• Users must pass eligibility for financial assistance as per the Lender's policies. For details of lenders, please visit Our Partners.
• Users must have a minimum income of ₹28,000.

Nature of Services

CirclePe acts as an intermediary between trustworthy tenants and landlords to support their rental arrangements. We assist in rent agreements, connecting reliable tenants with landlords and vice versa, facilitating move-in and move-out reports, and enabling zero or minimal security deposits for tenants by facilitating personal loan facilities for advance rent payments through our lending partners. The Platform fee is to avail the services of CirclePe and it shall be charged and remain unchanged irrespective of whether the loan application with the lender is successful or not.

CirclePe acts solely as a technology platform that facilitates loans through its lending partners. It does not directly lend money.

Users must provide accurate and complete information during registration and comply with additional documentation requests when required.

The information provided by users may be used for compliance with laws, including KYC (Know Your Customer) and AML (Anti-Money Laundering) standards.

Loan approval is determined solely by lending partners based on their policies and criteria. CirclePe does not guarantee loan approval.

Loan terms, including interest rates, are determined by lending partners and are subject to their discretion.

Users agree to pay any fees or charges imposed by CirclePe for its Services. Fees are subject to revision without prior notice.

Communication Consent

By registering, users consent to be contacted by CirclePe, its representatives, or lending partners via email, SMS, WhatsApp, phone calls, or other channels for service-related communication.

Users authorize CirclePe to access their financial information, including credit reports, for service facilitation.

Limitation of Liability

The Services are provided on an "as is" and "as available" basis without any warranties, express or implied.

CirclePe is not liable for any direct, indirect, or consequential damages resulting from the use of its Services, including but not limited to denial of credit by lending partners.

CirclePe is not responsible for system interruptions, inaccuracies, or data loss arising from the use of its Services.

Assignment of Rights

Users cannot transfer their rights or obligations under these Terms without prior written consent from CirclePe.

CirclePe reserves the right to transfer or assign its rights and obligations without prior notice to users.

Arbitration and Governing Law

These Terms are governed by the laws of India, with disputes subject to the jurisdiction of courts in New Delhi.

CirclePe reserves the right to recover legal costs and expenses incurred in enforcing these Terms.

Modification of Terms

CirclePe may update these Terms at its discretion. Continued use of the Services after updates constitutes acceptance of the revised Terms.

Severability

If any provision of these Terms is deemed unenforceable, the remaining provisions will remain in full effect.

No Waiver

Failure by CirclePe to enforce any part of these Terms does not constitute a waiver of its rights or provisions.
